A Party Wall is a structure which adjoins two or more buildings, this can also extend to a boundary wall and the Party Wall Act can be applicable to any excavations near a boundary or adjoining property. This Act provides the owner of a property the legal right to undertake certain works that might otherwise constitute trespass or nuisance. If works are being planned to your property, a neighbouring property or near a boundary then the Party Wall etc. Act 1996 may be applicable.

If you are planning to undertake your own construction works which may fall within the scope of the Party Wall etc. Act 1996 we can advise which Notices will be required and ensure these are produced and served correctly on all relevant parties.  We can then either act as the Building Owner's Surveyor or Agreed Surveyor to ensure all required Party Wall Awards are in place before the commencement of any works.

 

If  you have had a Party Wall Notice served on you by a neighbouring property we can review and advise on your initial response, as well as acting on your behalf as Adjoining Owner's Surveyor to ensure all Party Wall Awards are in place before commencement of the works.

Acting for Building Owner
We will undertake local searches to obtain ownership details to allow preparation and submission of the necessary notice to adjoining owners. Where required, a Schedule of Condition of the party structure in question would be undertaken. The relevant notices and and awards would be produced and agreed with the adjoining owner's surveyor. Liaison with the adjoining owner's surveyor woudl conitnue throughout the works through to completion.

 

Acting for Adjoining Owner
We would examine the notices submitted by the building owner's surveyor, visit the site and negotiate the award. A Schedule of Condition would be prepared. Negotiations and liaison would continue throughout the project through to completion.

 

At completion, the Schedule of Condition would be reviewed and any remedial works would be agreed and implemented.

 

Party Wall Matters are undertaken in accordance with the Party Wall etc. Act 1996 and RICS Guidance.
